These Terms and Conditions (“Terms”) govern your access to and use of the MC² Finance platform (“Platform”).
The Platform is operated by MC2Fi AG, Grabenstrasse 7a, CH-6340 Baar, Canton Zug, Switzerland, CHE-354.762.383 (“MC2Fi AG”, “we”, “our”, “us”).

1. Scope and Acceptance
1.1. These Terms govern your (“User”, “you”) access to and use of the MC² Finance Platform, including all related web, API, analytical, portfolio, and community features.
1.2. By accessing or using the Platform, you confirm that you have read, understood and accepted these Terms, which constitute a legally binding agreement. If you do not accept these Terms, you must refrain from accessing or using the Platform.
2. Service Description and Legal Status
2.1. The Platform is a non-custodial, decentralized software service providing tools for analysis, management, and execution of digital asset transactions and related analytics.
2.2. MC2Fi AG does NOT offer:
- Investment advice, asset management, brokerage, custody, or any regulated financial or payment services.
- Any offer or solicitation to buy or sell any securities, financial instruments, or regulated products.2.3. MC2Fi AG is NOT subject to supervision by the Swiss Financial Market Supervisory Authority (FINMA) or any comparable foreign regulator.
3. User Eligibility and Access Restrictions
3.1. You may only access and use this Platform if you:
- Are at least 18 years of age or the age of legal majority in your jurisdiction.
- Have full legal capacity and authority to enter into these Terms.
3.2. You must NOT access or use the Platform if:
- You are a resident or citizen of any jurisdiction subject to comprehensive sanctions, embargoes, or restrictions under the laws of Switzerland, the European Union, or the United States (including, but not limited to, Cuba, Iran, North Korea, Syria, and Crimea).
- You are on the U.S. Department of Treasury’s OFAC Sanctions List or similar Swiss/EU lists.
- You are a “U.S. Person” as defined under Regulation S of the U.S. Securities Act who seeks to use MC² Finance for activities not intended for U.S. Persons. The Platform is NOT intended for the use of U.S. Persons.
3.3. You are solely responsible for understanding and complying with the laws and regulations applicable to you.
4. Account Registration and Data Protection
4.1. To use parts of the Platform, you may be required to connect a self-custody digital wallet, select a username, and optionally link social accounts.
4.2. The Platform does not require full KYC/AML verification for typical access, but MC2Fi AG reserves the right to request additional identification or information in accordance with legal obligations or in the event of suspicious activity.
4.3. MC2Fi AG processes personal data in compliance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the GDPR.

5. User Responsibilities and Acceptable Use
5.1. As a User, you undertake:
- To use the Platform only as permitted by applicable law and these Terms.
- Not to access or use the Platform for money laundering, terrorist financing, market manipulation, the violation of sanctions, or any illicit, fraudulent, or otherwise prohibited activity.
- Not to interfere with the security, functionality, or availability of the Platform or submit any malicious code.
5.2. You are solely responsible for the security of your digital wallets, private keys, and account credentials.
MC2Fi AG cannot assist with recovery of lost access or funds.
6. Non-Custodial and Third-Party Services
6.1. The Platform is strictly non-custodial: MC2Fi AG never holds, accesses, or controls Users’ funds or private keys.
6.2. The Platform interoperates with third-party technical providers and data analytics services, including but not limited to TradingView, Aarc, Beebop, Reown, LI.FI, Amplitude, Google Analytics, and Cloudflare, as well as fiat on/off-ramp partners.
MC2Fi AG makes no warranty and assumes no liability for the acts or omissions of such third parties.
6.3. Where fiat on/off-ramps are available, these are operated by independent partners; MC2Fi AG is not party to any fiat transaction and does not intermediate, execute, or guarantee such transactions.
7. Platform Features and Community Content
7.1. The Platform enables Users to post content (such as portfolio names and usernames) or link social accounts. MC2Fi AG does not proactively moderate or review such user-generated content; you are solely responsible for your submissions and warrant that you will not submit any unlawful, defamatory, or infringing materials.
7.2. By submitting content, you grant MC2Fi AG a non-exclusive, global, royalty-free licence to use, store, display, publish, or reproduce such content on or via the Platform.
8. Risk Disclosure
8.1. Digital assets are volatile and high-risk. You acknowledge and accept the risks of:
- Sudden value loss, technical failures, protocol or smart contract bugs, “hacks” or exploitations, market manipulation, and regulatory developments.
- Irreversible loss or theft of assets from errors, attacks, or insufficient security.
8.2. Use of the Platform, including third-party or partner integrations, is entirely at your own risk.
9. No Warranties / Limitation of Liability
9.1. The Platform is provided strictly “as is” and “as available,” without warranty of any kind, whether express or implied, including merchantability, accuracy, fitness for purpose, or availability.
9.2. To the maximum extent permitted by law, MC2Fi AG and its affiliates accept no liability for any direct, indirect, incidental, punitive, or consequential loss or damages suffered by you in connection with the Platform, including lost profits, lost data or funds, or inability to access assets—regardless of cause.
9.3. Nothing in these Terms limits our liability for wilful misconduct or gross negligence under Swiss law.
10. Indemnification
You agree to fully indemnify, defend, and hold harmless MC2Fi AG, its directors, employees, affiliates, contractors, and agents against all claims, damages, liabilities, costs, or expenses (including legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any law or third-party right.
11. Amendments and Updates
11.1. MC2Fi AG reserves the right to amend these Terms at any time.
11.2. Updated Terms take effect upon publication on the Platform; your continued use constitutes acceptance. Previous versions will be made available upon written request.
12. Governing Law and Dispute Resolution
12.1. These Terms are governed by the substantive laws of Switzerland.
12.2. The exclusive place of jurisdiction for all disputes shall be the courts of Zug, Switzerland.
12.3. The English language shall apply to the interpretation of these Terms and in all legal proceedings.
13. Severability
If any part of these Terms is determined to be invalid or unenforceable under applicable law, the remaining provisions will remain in effect.
14. Entire Agreement
These Terms, together with any referenced policies, constitute the entire agreement between you and MC2Fi AG regarding your use of the Platform, superseding all prior understandings.
